Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using any software, tools, utilities, or services provided by Pixplash Labs (“Software”), you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Software.

2. Eligibility

You must be at least 18 years old or have legal parental or guardian consent to use the Software. By using the Software, you represent that you have the legal capacity to enter into this agreement.

3. License Grant

Pixplash Labs grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on a single device for personal or commercial use, subject to these Terms and successful license verification via Gumroad.

3.1 License Restrictions

• You may not share, sell, sublicense, rent, lease, or distribute license keys
• You may not reverse engineer, decompile, or disassemble the Software
• You may not bypass or tamper with licensing, activation, or protection mechanisms
• You may not use the Software for unlawful or harmful purposes

4. Ownership and Intellectual Property

All rights, title, and interest in and to the Software, including source code, binaries, algorithms, designs, UI, branding, logos, and documentation, remain the exclusive property of Pixplash Labs. These Terms do not grant you ownership of the Software.

5. Activation and License Validation

License activation is performed through Gumroad’s secure API. Activation may require an internet connection. Pixplash Labs reserves the right to verify license validity periodically to prevent misuse, fraud, or unauthorized distribution.

6. Payments and Refunds

All payments are processed by Gumroad. Pixplash Labs does not store or process payment information directly.

Refunds, chargebacks, and disputes are governed by Gumroad’s refund policy. Pixplash Labs reserves the right to deny refunds for license abuse, repeated activations, or policy violations.

7. Updates and Feature Changes

The Software may receive updates, patches, bug fixes, or performance improvements. Minor updates are included with your license. Major version upgrades or feature expansions may require a separate purchase.

Pixplash Labs reserves the right to modify, add, or discontinue features at any time without liability.

8. User Data and Privacy

Pixplash Labs does not collect, upload, or store your personal images, files, or content. Any processing occurs locally on your device unless explicitly stated.

Limited technical data (such as license status or error logs) may be collected solely to ensure functionality and prevent abuse. Please refer to our Privacy Policy for full details.

9. Third-Party Services

The Software may rely on third-party libraries, APIs, or services. Pixplash Labs is not responsible for third-party outages, changes, or failures beyond its control.

10. Disclaimer of Warranties

The Software is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

Pixplash Labs does not guarantee uninterrupted operation, error-free performance, or compatibility with all systems or configurations.

11. Limitation of Liability

To the maximum extent permitted by law, Pixplash Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or system failures arising from the use or inability to use the Software.

Total liability shall not exceed the amount paid for the Software license.

12. User Responsibilities

• Ensure lawful use of the Software
• Maintain the confidentiality of your license key
• Backup your data before processing files
• Comply with applicable local and international laws

13. Termination

Pixplash Labs reserves the right to suspend or revoke licenses without notice if these Terms are violated. Upon termination, you must cease all use of the Software and destroy all copies.

14. Export Control

You agree to comply with all applicable export laws and regulations. You may not use or export the Software in violation of applicable restrictions.

15. Force Majeure

Pixplash Labs shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, internet outages, government actions, or service interruptions.

16. Changes to These Terms

Pixplash Labs may update these Terms from time to time. Continued use of the Software after changes become effective constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
